SCHEDULE OF ARBITRATION COSTS

OF THE VIETNAM INTERNATIONAL ARBITRATION CENTRE

The amount fixed in accordance with the Scale in the above-mentioned Item 1 or 2 is intended to cover remuneration of arbitrator(s) and the VIAC’s administrative fees relevant to the resolution of the dispute. Upon submission of a Request for Arbitration and a Counterclaim, the parties shall pay this amount in full. This amount shall not include travel and accommodation expenses incurred by arbitrator(s) of the Arbitral Tribunal and a secretary of any hearing as well as other relevant costs. Such costs shall be calculated on the basis of expenses arising in practice. The payment and accounting of these costs are provided for in Article 33 of the Rules of Arbitration of the Vietnam International Arbitration Centre.

 

The Refunding:

1.      The arbitration costs shall be refunded in the following circumstances:

1.1. If a Request for Arbitration or a Counterclaim is withdrawn or settled by the parties before the constitution of the Arbitral Tribunal, the Centre shall refund 60 % of the arbitration costs to the party that has made the advance payment. However, in any circumstance the remaining amount for costs shall not be less than USD 700.

1.2. If a Request for Arbitration or a Counterclaim is withdrawn or settled by the parties after the constitution of the Arbitral Tribunal, the Centre shall refund 40% of the arbitration costs to the party that has made the advance payment.

1.3. If a Request for Arbitration or a Counterclaim is withdrawn or settled by the parties after the Centre has sent the summon to the hearing, but before the date of opening the hearing, the Centre shall refund 20% of the arbitration costs to the party that has made the advance payment.

2.      For all other circumstances, no refunds shall be granted.
